Merlin in Fort Erie?

Shannon, one of our readers from Fort Erie sent us this question - Earlier today I was in the Walmart parking lot in Fort Erie, Ontario, when I saw a bird that was obviously a bird of prey. It swooped down into the dirt compound and ran under a skid of dirt to catch a mouse. It looked like a Merlin, but I was looking on the internet and they aren't located in the area. Is it possible for them to be in the area?

I'm not sure if it would be a Merlin in the Fort Erie area, perhaps one of our readers would know.
